Products may appear different than those shown in photos due to external factors like lighting.

While we make every effort to accurately represent our products in photographs, please note that variations may occur due to the following factors: 

Natural Wood Grain: Each piece of wood has a unique grain pattern, color, and texture. 

Lighting Conditions: Photography lighting and your screen settings can affect how colors appear.

Handcrafted Nature:Our products are handcrafted, so slight variations in size and finish are inherent to the process.

We encourage you to appreciate these natural variations as part of the unique character of each piece.

We strive to provide accurate product images, but due to the nature of wood and photography, some variations in appearance may occur. These variations are not considered defects and do not affect the functionality or quality of the product. By placing an order, you acknowledge and accept these potential variations.

If you don't like our products, you can feel free to return them within 7 days of delivery.

We offer a 7-day return policy on most items. To be eligible for a return, your item must be unused and in the same condition that you received it, with all original packaging. Some items are exempt from returns, including:  

  • Custom-designed or personalized items
  • Items damaged after delivery
  • Sale or clearance items

Please contact us within 7 days of delivery to initiate a return. 

Return shipping costs are the responsibility of the customer.

All returns are subject to a 10% restocking fee

Understanding Custom Finishes

We offer a range of finishes to complement your style, including natural oil finishes, durable polyurethane coatings, and painted options. While the expected lifespan of our finishes varies depending on usage and care, we strive for lasting beauty and protection. Custom finishes are hand-applied and may exhibit unique variations, adding to the character of each piece.

Expected Lifespan:

The lifespan of our finishes depends on various factors, including:

  Type of finish: Some finishes are inherently more durable than others.

  Environmental conditions: Exposure to sunlight, moisture, and temperature fluctuations can affect the longevity of the finish.

  Care and maintenance: Proper cleaning and maintenance can significantly extend the life of the finish.

While we strive to provide high-quality finishes with a long lifespan, please note that all finishes will naturally show some wear and tear over time.

Custom Finishes:

Our custom finishes create truly unique and personalized pieces. These finishes are hand-applied and may exhibit slight variations in color, texture, and sheen. These variations are inherent to the handcrafted nature of the process and are not considered defects.

Disclaimer:

By placing an order with us, you acknowledge and accept that custom finishes may vary slightly from piece to piece and that these variations are not a valid reason for rejection of the finished product.

Deposit Requirment

All custom orders require a non-refundable deposit as specified in the project quote. 

This deposit secures your place in our production schedule and allows us to begin the design and material procurement process.

Your project enters our production schedule only after deposit has been received. 

Non-Refundable Nature of Deposit

Please note that the deposit is non-refundable, except in the following circumstances:

  • Cancellation by Us: If we are unable to fulfill your order due to unforeseen circumstances, we will refund your deposit in full.
  • Significant Design Changes: If you request significant design changes that we are unable to accommodate, and we mutually agree to cancel the order, we may refund your deposit in whole or in part at our discretion.

Purpose of the Deposit

The deposit serves several important purposes:

  • Secures Your Order: It confirms your commitment to the project and reserves your spot in our production schedule.
  • Covers Initial Costs: It helps us cover the initial costs associated with design, material sourcing, and project planning.
  • Protects Our Business: It protects us from financial losses in the event of order cancellations or significant changes.

Payment of the Deposit

The deposit is due upon acceptance of the design proposal and accepting project quote. 

 The remaining balance is due upon completion of the project and prior to delivery or installation.

Custom Designed Product Approval Process

Our design process includes two rounds of revisions to ensure your complete satisfaction. After the initial design presentation, you will have three business days to provide feedback. We will then revise the design based on your feedback and resubmit it for your final approval within three business days. If no further revisions are requested within this timeframe, we will consider the design approved and proceed with production.

Changes To Orders

Once a design has been approved and an order placed, any changes to the scope of the project must be submitted via email to IslandMillworks@ihpcb.com. Change orders will be reviewed by our team to assess their impact on materials, labor, and project timeline.

We will provide you with a detailed cost estimate for any approved changes. This estimate will include a breakdown of costs for materials, labor, and any applicable design fees. Payment for approved changes is due upon acceptance of the revised estimate.

Please note that changes to orders may result in adjustments to the project timeline. We will make every effort to minimize any delays, but we appreciate your understanding as we incorporate your requested modifications.

Examples of Chargeable Changes:

  • Modifications to Dimensions: Changes to the length, width, or height of a piece.
  • Material Substitutions: Switching from one type of wood to another.
  • Additions or Alterations to Design Elements: Adding shelves, drawers, or decorative accents.
  • Changes to Finishes: Switching from a painted finish to a stained finish, or vice versa.

We encourage open communication and collaboration throughout the entire process. Please do not hesitate to contact us with any questions or concerns regarding potential changes to your order.

Wood Selection

We take pride in selecting quality lumber for our handcrafted furniture. However, it's important to understand that wood is a natural material with inherent variations. These variations can include:

Grain Pattern: The natural lines and patterns in the wood, which can vary significantly from board to board.  

Color: Wood color can range from light to dark, even within the same species, and can be influenced by factors like the tree's age and growing conditions.  

Figure: Unique markings in the wood, such as knots, burls, and birdseye patterns, which add character but can also affect the overall appearance.  

Texture: The feel of the wood surface, which can be smooth, rough, or have variations in grain prominence.

While we are happy to provide wood samples, please note that these samples are intended to give a general idea of the wood species and color. Actual lumber used in your project may vary slightly in appearance.

Material Substitutions

We understand that sometimes material substitutions may be necessary due to unforeseen circumstances, such as:

  • Availability: The original material may become unavailable or have extended lead times.  
  • Quality: The available stock of the original material may not meet our quality standards.
  • Cost: Significant price increases in the original material may make it impractical to use.
  • Client Preference: The client may request a substitution for aesthetic or functional reasons.

Procedure for Material Substitutions:

If a material substitution becomes necessary, we will follow this procedure if a material substitution will if it will greatly change the function or appearance of the product.:

  1. Notification: We will promptly notify you of the need for a substitution, explaining the reason and providing details about the proposed alternative material, 
  2. Comparison: We will provide information about the proposed substitute, including its properties, appearance, and any potential impact on cost or project timeline.
  3. Approval: We will obtain your written approval before proceeding with the substitution.
  4. Documentation: We will document the agreed-upon substitution in writing, including any adjustments to the price or timeline.

Potential Costs:

Material substitutions may result in changes to the project cost. These changes could include:  

  • Increased cost: If the substitute material is more expensive than the original.
  • Decreased cost: If the substitute material is less expensive than the original.
  • Labor adjustments: If the substitute material requires different handling or installation methods.

We will provide a clear and detailed explanation of any cost adjustments associated with the substitution before proceeding.

Disclaimer:

While we make every effort to avoid material substitutions, we reserve the right to make substitutions when necessary. We will always prioritize quality and strive to find suitable alternatives that meet your expectations and the design intent of the project. We reserve the right to proceed with the product if the change in materials will not greatly change the function or appearance of the final product. Material substitution is not a valid reason for rejection of final product. 

Warranty

We stand behind the quality of our craftsmanship and materials. 

We offer a 90 day warranty on all custom woodworking products and projects, covering defects in materials and workmanship under normal use and conditions.

Coverage:

This warranty covers the following:

  • Structural Integrity: Defects in the structural integrity of the piece, such as joints failing, warping, or cracking.
  • Material Defects: Defects in the wood itself, such as excessive knots, splits, or decay that were not present at the time of delivery.
  • Hardware Functionality: Malfunctioning hardware, such as hinges, drawer slides, or door catches.
  • Finish Defects: Defects in the finish, such as peeling, cracking, or excessive fading, that are not due to normal wear and tear or improper care.

Exclusions:

This warranty does not cover:

  • Normal Wear and Tear: Expected wear and tear from regular use, such as minor scratches, dents, or fading of the finish over time.
  • Improper Care: Damage caused by improper care, cleaning, or maintenance, including the use of harsh chemicals or abrasive materials.
  • Modifications: Alterations or modifications made to the product after delivery, unless authorized by us in writing.
  • Environmental Damage: Damage caused by exposure to extreme temperatures, humidity, sunlight, or moisture.
  • Accidental Damage: Damage caused by accidents, misuse, abuse, or neglect.
  • Commercial Use: Products used in commercial settings, for commercial purposes, within commercial properties, including short term vacation rentals, or within any business, are sold as is where is and no warranty coverage applies. 

Warranty Claim Procedure:

To make a warranty claim, please contact us by email within the warranty period and provide:

  • Your order information: Order number, date of purchase, and product details.
  • Description of the defect: A clear and detailed description of the issue.
  • Photographs or videos: Visual evidence of the defect.

We will review your claim and, if approved, we will repair or replace the defective product or part at our discretion.

Disclaimer:

This warranty is in lieu of all other warranties, expressed or implied, including any warranty of merchantability or fitness for a particular purpose. We are not liable for any incidental or consequential damages arising from the use of our products to include use by any of your guests, customers, or anyone else who you, knowingly or unknowingly, allow to use our products. 

Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to our products, services, or this agreement, even if we have been advised of the possibility of such damages. This includes, but is not limited to, loss of profits, loss of use, loss of data, or any other economic loss.  

Our total liability to you for any claim arising out of or relating to our products, services, or this agreement shall be limited to the amount you paid for the specific product or service that is the subject of the claim.

Indemnification

You agree to indemnify and hold us harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to:  

  • Your use of our products or services.
  • Your breach of this agreement.
  • Your negligence or misconduct.
  • Any third-party claims arising out of your use of our products or services.
Dispute Resolution

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.  

Dispute Resolution  

Any dispute arising out of or relating to these Terms and Conditions, or the breach thereof, shall be settled by one of the following methods:

  • Negotiation: The parties agree to first attempt to resolve any dispute through good faith negotiation.
  • Mediation: If negotiation fails, the parties agree to submit the dispute to mediation in Panama City, FL in accordance with the rules of the American Arbitration Association.
  • Arbitration: If mediation fails, or if the parties agree to bypass mediation, the dispute shall be settled by binding arbitration in Panama City, FL in accordance with its Commercial Arbitration Rules. The arbitrator's award shall be final and binding, and judgment may be entered upon it in any court having jurisdiction.

Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck from these Terms and Conditions and the remaining provisions shall remain in full force and effect.  

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Island Millworks Co. with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
